The Supreme Court has dismissed a petition challenging the Nepal-India power trade agreement. The petition, filed by Surya Nath Upadhyaya, was dismissed following a hearing at the court.

A full bench comprising Chief Justice Prakash Man Singh Raut, Justice Sapana Pradhan Malla, and Justice Mahesh Sharma Paudel issued the dismissal order regarding the petition, which had sought the cancellation of the Nepal-India power trade agreement.

Along with the dismissal, the top court issued a directive order concerning the agreement. The specifics of this directive have not yet been made public, though further details will be included in the court’s written order.

Upadhyay had named the Prime Minister, the Office of the Prime Minister and Council of Ministers, the Ministry of Energy, Water Resources and Irrigation, the Ministry of Foreign Affairs, the Ministry of Finance, and the Ministry of Law, Justice and Parliamentary Affairs as defendants in the case.

The Nepal-India power trade agreement, signed at the secretary level on January 4, 2024, stipulates that Nepal will export 10,000 megawatts of electricity to India over the next ten years.
